Welcome to Trend Express ("Website", "Platform", "we", "us", or "our"), an e-commerce platform operated by Trend Express FZCO, a company registered with the International Free Zone Authority (IFZA) in Dubai, United Arab Emirates.

By accessing, browsing, registering, or purchasing through this Website, you ("User", "Customer", "you") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). If you do not agree, you must not use this Website.

We reserve the right to modify these Terms at any time. Material changes will be notified via the Website or email. Continued use after updates constitutes acceptance.

2. ELIGIBILITY & CAPACITY
To use this Website, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction.
  •  Have legal capacity to enter binding contracts under UAE law.

4. INTELLECTUAL PROPERTY RIGHTS
All content on this Website—including text, graphics, logos, icons, images, software, trademarks, and trade names—is the exclusive property of Trend Express or its licensors and is protected under:

  • UAE Federal Law No. 7 of 2002 on Copyrights and Neighbouring Rights.
  • UAE Federal Law No. 36 of 2021 on Trademarks.
  • International intellectual property treaties applicable in the UAE.

You may not reproduce, distribute, modify, scrape, or commercially exploit any content without prior written consent.

5. PROHIBITED CONDUCT & UAE LEGAL COMPLIANCE
You agree not to use the Website to:

  • Violate any UAE federal or Dubai emirate law, including:

o Federal Decree-Law No. 34 of 2021 on Combating Rumors and Cybercrimes;

o Federal Decree-Law No. 45 of 2021 on Personal Data Protection (PDPL);

o Federal Law No. 15 of 2020 on Consumer Protection;

o Federal Law No. 1 of 2006 on Electronic Commerce and Transactions.

  • Upload content that is defamatory, obscene, fraudulent, threatening, discriminatory, or contrary to UAE public order, morals, or Islamic values.
  •  Engage in unauthorized data scraping, hacking, DDoS attacks, malware distribution, or interference with Website security.
  •  Misrepresent identity, affiliation, or commercial intent.
  •  Resell products purchased from the Website in violation of manufacturer terms or UAE commercial regulations.

 Violations may result in immediate account termination and reporting to UAE authorities or IFZA compliance units.

6. PRODUCTS, PRICING, PAYMENTS & VAT

6.1 Product Information

  • Product descriptions, images, and specifications are for illustrative purposes. We strive for accuracy but do not guarantee that all information is error-free.
  • · Colors may vary due to screen settings. Final product appearance is as delivered.

6.2 Pricing & Currency

  • All prices are displayed in UAE Dirhams (AED) unless otherwise stated.
  • Prices are subject to change without notice. Promotional prices are valid only for the stated period.
  •  Prices exclude 5% UAE VAT unless explicitly stated. VAT will be calculated and added at checkout per UAE Federal Decree-Law No. 8 of 2017.

6.3 Payments

  • Payments are processed via secure, PCI-DSS compliant third-party gateways (Telr, PayTabs, Stripe, or others).
  • By completing a purchase, you authorize us to charge the total amount (including VAT and shipping) to your selected payment method.
  • We reserve the right to verify payment details and decline any order for fraud prevention or inventory reasons.

7. ORDER ACCEPTANCE, SHIPPING & DELIVERY

7.1 Order Confirmation

  • Receipt of an order confirmation email does not constitute acceptance. We reserve the right to accept or decline any order at our discretion.

7.2 Shipping & Delivery

  • Delivery timelines are estimates only. We are not liable for delays caused by:

o Customs clearance procedures (for cross-border GCC/international orders);

o Force majeure events (see Section 14);

o Courier service disruptions;

o Incorrect or incomplete address information provided by you.

  • Risk of loss or damage transfers to you once the is delivery to the address specified at checkout.

7.3 Cross-Border Considerations

  •  For deliveries outside the UAE, you are responsible for any import duties, taxes, or customs fees imposed by the destination country. These are not included in checkout pricing.

8. RETURNS, REFUNDS & CANCELLATIONS (UAE CONSUMER PROTECTION COMPLIANT)

Our return policy aligns with UAE Federal Law No. 15 of 2020 on Consumer Protection and IFZA commercial guidelines:

8.1 Right to Cancel/Return

  • You may request cancellation before shipment or return within 14 calendar days of receipt for most physical goods, provided items are:

    o Unused, in original condition, with tags and packaging intact.

o Accompanied by proof of purchase (order number/invoice).

  •  Certain items are non-returnable unless defective: personalized/customized products, digital downloads, perishables, intimate apparel, or sealed hygiene items (as permitted under Article 13 of the UAE Consumer Protection Law).

8.2 Refund Process

  • Approved refunds will be processed to the original payment method within 14 business days of inspection and approval.
  •  Return shipping costs are borne by the Customer unless the return is due to our error or a defective product.

8.3 Defective or Incorrect Items

  •  If you receive a defective, damaged, or incorrect item, contact us within 48 hours of delivery at support@trendexpress.ae with photos/evidence. We will arrange replacement, repair, or refund at our discretion.

9. PRIVACY & DATA PROTECTION (UAE PDPL COMPLIANT)

10. DISCLAIMERS & LIMITATION OF LIABILITY

10.1 Service "As Is"

  • The Website and services are provided "as is" and "as available" without warranties of any kind, express or implied, beyond those expressly mandated by UAE law.

10.2 Limitation of Liability

  • To the maximum extent permitted by UAE law (including Article 390 of UAE Civil Code), Trend Express shall not be liable for:

o Indirect, incidental, consequential, or punitive damages.

o Loss of profits, data, goodwill, or business opportunities.

o Errors, delays, or interruptions in Website functionality.

  • Our total aggregate liability for any claim arising from these Terms or your use of the Website shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for fraud, gross negligence, or death/personal injury resulting from our negligence, as prohibited by UAE law.

11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Trend Express, its directors, employees, affiliates, agents, and IFZA-registered representatives from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms.
  •  Your misuse of the Website or violation of UAE/IFZA regulations.
  •  Your infringement of third-party intellectual property or privacy rights.

12. TERMINATION & SUSPENSION

We reserve the right to:

  • Suspend or terminate your account or access to the Website immediately, without prior notice, if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or violated UAE/IFZA law;
  • Discontinue, modify, or restrict access to any part of the Website at any time for maintenance, security, or business reasons.

Termination does not affect accrued rights, obligations, or any provisions that by their nature should survive (e.g., indemnification, limitation of liability, governing law).

13. GOVERNING LAW, DISPUTE RESOLUTION & LANGUAGE

13.1 Governing Law

  •  These Terms shall be governed by and construed in accordance with the federal laws of the United Arab Emirates, as applied in the Emirate of Dubai. IFZA regulations shall supplement where applicable to our corporate status.

13.2 Dispute Resolution

  • Parties shall first attempt to resolve disputes amicably through direct negotiation within 30 days.
  •  If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE.
  •  Optional Clause (if legally advised): "Notwithstanding the above, parties may agree in writing to refer disputes to arbitration under the Dubai International Arbitration Centre (DIAC) Rules."

13.3 Language Clause

  • These Terms are provided in English for convenience. In the event of any discrepancy between the English and Arabic versions, the Arabic version shall prevail before UAE courts, regulatory authorities, and IFZA compliance bodies, as required under UAE commercial practice.

14. FORCE MAJEURE

 Trend Express shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government actions, pandemics, labor disputes, telecommunications failures, or disruptions to IFZA/free zone infrastructure.

15. AMENDMENTS & NOTICES

  • We may update these Terms at any time. Material changes will be communicated via prominent notice on the Website or email to your registered address.
  •  Notices to us should be sent to: support@trendexpress.ae.
  • Notices from us to you will be sent to your registered email or via Website notification.
